Selling a Home After Someone Passes Away: What About Probate?
Selling a home after someone passes away is a little different than a regular sale, and probate is one of the things that can come into play.
Before you watch, there are two important updates since we recorded this video:
Probate: Manitoba real estate requirements have changed. Probate now needs to be completed before we can list the property for sale.
Ashton Freund: Ashton has changed law firms since we recorded this video and can now be found at DD West LLP in Winnipeg.
That doesn't mean you have to sit and do nothing while you're waiting for probate.
There can be A LOT to deal with when you're selling a family member's home, especially if they've lived there for many years. There may be decades of belongings to go through, things to donate or sell, repairs to think about and decisions about what is actually worth doing before the home goes on the market.
This is where starting early can really help.
We can walk through the home with you, give you an idea of what it may be worth and help you figure out what should be done before selling and, just as importantly, what probably isn't worth spending money on.
Then while the lawyer is dealing with probate, you can work through everything else without feeling like it all has to happen at once.
Every estate is a little different, so we always recommend talking to the estate lawyer about the legal side and what applies to your particular situation.
On the real estate side, we're happy to help you figure out the house part of it and give you a place to start.
